Terms of Service
These Terms govern the planned Jev Benchmark Lab website and report service. By using the Service or buying a report, you agree to these Terms, the Privacy Policy, Refund Policy, and applicable Creem checkout terms.
1. Eligibility
You must be at least 18, legally able to enter a contract, and permitted to use the Service where you live.
2. What the Service provides
The Service is an independent hosted engineering evaluation tool for supported labeled CSV, JSON, or JSONL data. It can provide metrics, threshold analysis, fallback estimates, row-level results, and configuration drafts.
The launch paid offer is one report for up to 2,000 valid rows. It is not a subscription, credit pack, consulting service, or promise of future features. Normal use is fully self-service.
3. Your data and permissions
You retain rights in your inputs and labels and grant only the limited rights needed to provide, secure, troubleshoot, and delete the requested report.
You confirm that you have all required rights, notices, consents, and lawful bases, that the data contains no prohibited information, and that the Service will not be used for high-impact eligibility decisions or as the sole basis for decisions about a person.
4. Acceptable use
- Do not submit secrets, payment data, regulated sensitive information, child data, or unlawfully obtained data.
- Do not use the Service for employment, credit, insurance, medical, education, housing, law-enforcement, immigration, or similar high-impact decisions.
- Do not bypass security, rate limits, access controls, billing, provider restrictions, or report tokens.
- Do not upload malware, scrape or overload the service, or misrepresent a report as certification or an official TypeSafe/OpenRouter result.
5. AI and report limitations
AI can be inaccurate, inconsistent, unavailable, or changed by providers. A report describes observed behavior on one dataset, label set, task, route, and model version. GO, CONDITIONAL GO, and NO-GO are engineering decision aids—not warranties of safety, legality, fairness, compliance, or future performance.
6. Orders, payment, and Merchant of Record
Creem acts as Merchant of Record and contractual reseller, processing checkout, payment, invoices, fraud controls, and applicable indirect taxes. We remain responsible for delivery and refund eligibility.
Where law requires it, checkout will ask through a separate unselected control for immediate performance and the applicable withdrawal acknowledgement.
7. Delivery, retries, and access period
Recoverable errors may retry without a new charge. A run is not fully delivered unless it reaches COMPLETE. Reports are available for up to seven days and may be deleted sooner. PARTIAL, FAILED, and delayed states remain truthful and follow the Refund Policy.
8. Refunds
Refunds follow the Refund Policy and are processed through Creem. Mandatory consumer remedies prevail over conflicting limitations.
9. Availability and changes
We may modify, suspend, or discontinue features for security, legal, provider, abuse, capacity, or commercial reasons. An accepted paid run will be delivered under its disclosed contract, rerun where appropriate, or refunded where required.
10. Intellectual property
Except for your data and third-party materials, we retain rights in the service, software, report design, and original content. Third-party names identify compatibility only and do not imply sponsorship or endorsement.
11. Feedback
Feedback that contains no confidential benchmark data may be used to improve the Service. Do not include datasets, secrets, or report content.
12. Warranty disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Non-waivable consumer rights remain unaffected.
13. Limitation of liability
To the maximum extent permitted by law, aggregate liability for a claim relating to a report will not exceed the amount paid for that report. Exclusions do not apply where prohibited by law.
14. Indemnity for business users
Business users will defend and indemnify us against third-party claims arising from unlawful data, missing rights or consents, prohibited use, or material breach, except to the extent caused by our breach or unlawful conduct.
15. Termination
You may stop using the Service and delete an active report. We may suspend access for a material violation, security risk, fraud, legal requirement, or provider restriction without removing applicable refund or consumer rights.
16. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, subject to mandatory consumer protections. Before filing a claim, contact legal@jevbenchmark.app.
17. Changes to these Terms
The version accepted at checkout governs that paid run except where a mandatory legal change applies. Material changes will be posted prospectively.
